Nations<\/em><\/strong><\/h2>\n<p>Alors que l\u2019Accord-cadre relatif \u00e0 la gestion des terres des Premi\u00e8res Nations entreprend sa 25<sup>e<\/sup> ann\u00e9e d\u2019appui \u00e0 la gouvernance des terres des Premi\u00e8res Nations, nous croyons qu\u2019il est important de souligner et de partager les origines de son existence.<\/p>\n<p>Vers la fin des ann\u00e9es\u00a01980, un groupe national de chefs d\u00e9vou\u00e9s ont analys\u00e9 l\u2019efficacit\u00e9 de la <em>Loi sur les Indiens<\/em> et ont conclu que\u00a0:<\/p>\n<ul>\n<li>La <em>Loi sur les Indiens<\/em> n\u2019offrait pas un fondement l\u00e9gal ad\u00e9quat aux Premi\u00e8res Nations pour r\u00e9gir les terres et les ressources naturelles de leurs r\u00e9serves;<\/li>\n<li>Il fallait reconna\u00eetre la capacit\u00e9 juridique des Premi\u00e8res Nations pour qu\u2019elles puissent exercer leurs droits inh\u00e9rents de gouverner les terres et les ressources naturelles de leurs de r\u00e9serves.<\/li>\n<\/ul>\n<p>Au d\u00e9but des ann\u00e9es\u00a01990, ces m\u00eames chefs ont commenc\u00e9 \u00e0 se concentrer sur le concept d\u2019un accord de gouvernement \u00e0 gouvernement avec le Canada qui reconna\u00eetrait ces droits inh\u00e9rents. Le point culminant du travail a \u00e9t\u00e9 l\u2019\u00e9laboration et la signature de l\u2019Accord-cadre relatif \u00e0 la gestion des terres des Premi\u00e8res Nations (Accord-cadre).<\/p>\n<p>Le but de l\u2019Accord-cadre \u00e9tait de permettre aux Premi\u00e8res Nations de reprendre le contr\u00f4le de leurs terres de r\u00e9serve, de leurs ressources naturelles et de leur environnement \u00e0 l\u2019usage et au profit de leurs membres sans intervention du gouvernement, en rempla\u00e7ant les dispositions de la <em>Loi sur les Indiens<\/em> relatives aux terres par des lois adopt\u00e9es par les Premi\u00e8res Nations.<\/p>\n<p>\u00c0 la suite de n\u00e9gociations, treize chefs de Premi\u00e8res Nations ont sign\u00e9 le 12 f\u00e9vrier 1996 l\u2019Accord-cadre avec le Canada. Une quatorzi\u00e8me Premi\u00e8re Nation a adh\u00e9r\u00e9 \u00e0 l\u2019Accord-cadre en mai 1998. La conclusion de l\u2019Accord\u2011cadre constitue un moment unique dans l\u2019histoire du Canada o\u00f9 un groupe de Premi\u00e8res Nations s\u2019est r\u00e9uni pour concevoir, n\u00e9gocier et signer un accord de gouvernement \u00e0 gouvernement avec le gouvernement f\u00e9d\u00e9ral visant \u00e0 reconna\u00eetre leur droit inh\u00e9rent \u00e0 l\u2019autonomie gouvernementale.<\/p>\n<p>L\u2019Accord-cadre remplace les 44 articles de la <em>Loi sur les Indiens<\/em> relatifs aux terres par les propres lois des Premi\u00e8res Nations adopt\u00e9es dans le contexte d\u2019un code foncier \u00e9labor\u00e9 et approuv\u00e9 par la communaut\u00e9. \u00c0 la suite de l\u2019adoption de son code foncier, une Premi\u00e8re Nation peut r\u00e9gir ses terres de r\u00e9serve, ses ressources naturelles et son environnement selon ses propres valeurs et priorit\u00e9s culturelles. Les communaut\u00e9s des Premi\u00e8res Nations peuvent d\u00e9sormais \u00e9voluer au rythme des affaires, traiter plus rapidement les transactions fonci\u00e8res et favoriser un climat plus attrayant pour les affaires et les investissements, cr\u00e9ant ainsi davantage d\u2019emplois et de retomb\u00e9es \u00e9conomiques.<\/p>\n<p>L\u2019Accord-cadre a fait ses preuves, ayant soustrait environ 12,5\u00a0% des Premi\u00e8res Nations du syst\u00e8me foncier colonial de la <em>Loi sur les Indiens<\/em>, tout en am\u00e9liorant la protection de l\u2019environnement et en facilitant un d\u00e9veloppement \u00e9conomique accru gr\u00e2ce \u00e0 des syst\u00e8mes modernes de gouvernance, d\u2019\u00e9laboration de lois et de politiques et \u00e0 une prise de d\u00e9cision en temps opportun. Contrairement \u00e0 la <em>Loi sur les Indiens<\/em>, les Premi\u00e8res Nations qui terminent le processus d\u2019adh\u00e9sion \u00e0 l\u2019Accord-cadre b\u00e9n\u00e9ficient d\u2019un syst\u00e8me d\u2019enregistrement des terres r\u00e9gi par un r\u00e8glement qui est fond\u00e9 sur les priorit\u00e9s, sans papier et instantan\u00e9.
